2) Les recours contentieux devant le Conseil D'Etat ou le Tribunal administratif
S'il s'agit de recourir contre la décision de la commission d'équivalence de diplômes «Votre diplôme ne présente pas un caractère technique ou scientifique suffisamment avéré», le recours contentieux doit être réalisé devant le Conseil d'Etat (car cela revient à recourir contre le décret n°2007-196 du 13 février 2007 qui instaure la dite Commission). Cette démarche est complexe et coûteuse. L'appui d'un avocat est nécessaire.
Recours devant le Conseil d'Etat
NB : si le recours est individuel, l'appui juridique de l'avocat peut être lié à une démarche collective.
Il est aussi possible de former un recours contentieux devant le Tribunal administratif si votre recours fait suite à une décision de votre délégation régionale du CNFPT («Vous ne nous avez pas transmis la décision favorable de la commission (…)»). Cette démarche est beaucoup plus simple et surtout gratuite.
